Martin: No Decision To Appeal Jackson Ruling

FCC Chairman Kevin Martin said Wednesday that he has not decided whether to appeal a court decision reversing the fine imposed on CBS stations for broadcasting the Janet Jackson "wardrobe malfunction" incident. As reported by Broadcasting & Cable, Martin said during a C-span interview that he had been disappointed by the court's decision and noted that the incident has spurred Congress to increase the FCC's ability to fine stations. "It would be somewhat ironic if that prompted Congress to increase our fining authority but the courts actually said we were not able to fine them for that instance," he said.

Court Sets Aside Wardrobe Malfunction Fine

The FCC's crackdown on television indecency suffered a severe setback Monday as a federal court overturned the agency's $550,000 fine against CBS-owned stations for airing the Janet Jackson breast-baring incident with Justin Timberlake during the 2004 Super Bowl halftime show. In a unanimous decision, the three-judge appellate court ruled that the FCC had acted "arbitrarily and capriciously" by imposing new standards for indecency "without supplying notice of and a reasoned explanation for its policy departure." CBS issued a statement calling the decision "an important win for the entire broadcasting industry," noting that circumstances occur, "particularly during live programing, when it may not be possible to block unfortunate fleeting material." FCC Chairman Kevin Martin said that he was "surprised" and "disappointed" by the decision. The Parents Television Council, the group that deluged the FCC with protesting letters following the Jackson incident, called the ruling "judicial stupidity," and added, "If a striptease during the Super Bowl in front of 90 million people, including millions of children, doesn't fit the parameters of broadcast indecency, then what does?" CBS had maintained that it had no advance knowledge that the "striptease" would occur. And, in its decision the appeals court said that "the FCC cannot impose liability on CBS for the acts of Janet Jackson and Justin Timberlake," who were not employees of the network but "independent contractors hired for the limited purposes of the halftime show."

Jackson's Wardrobe Malfunction Fine Dropped

Federal officials have dismissed an indecency fine TV bosses at CBS were charged after Janet Jackson flashed a breast during the 2004 SuperBowl half-time show.

Just days after Jackson's fellow SuperBowl performer Justin Timberlake poked fun at the 'wardrobe malfunction' controversy while hosting the Espy Awards in Los Angeles, a three-judge panel has thrown out a $550,000 (GBP275,000) fine over the broadcast.

The judges of the 3rd U.S. Circuit Court of Appeals have ruled that the Federal Communications Commission "acted arbitrarily and capriciously" in issuing the fine for the split-second image of nudity.

During the live show, Timberlake ripped open Jackson's bodice, revealing a breast. A red-faced Jackson quickly covered up.

More than 90 million people saw the live broadcast.

Justin Timberlake turned stand-up comedian on Wednesday night when he hosted the Espy Awards - mocking his celebrity friends and poking fun at his controversial duet with Janet Jackson at the 2004 Super Bowl.

The sports-loving star took to the stage in Los Angeles for U.S. TV network Espn's Excellence in Sports Performance Yearly Awards ceremony.

Timberlake scored laughs with a comic performance in new movie The Love Guru - and tried out his act with a live audience at the event, picking on audience member Jessica Simpson and her American footballer boyfriend Tony Romo.

After giving them the nicknames RoJo and Tessica, Timberlake then recalled his infamous "wardrobe malfunction" with the breast-flashing Jackson four years ago.

He told the audience, "I wanted to be the only guy at a football game to get to second base."

Timberlake's on-stage antics can be seen when the awards show is aired in the U.S. on Sunday.

Jackson To Star In MTV Reality Series

R+B singer Janet Jackson is set to star in an upcoming reality TV series for MTV.

The project will follow Jackson as she mentors a group of aspiring singers and dancers in search of the next pop superstar through unconventional means.

Executive producer Dave Broome says of the series, "It's really about finding who's the next Janet Jackson or Justin Timberlake or Usher. And we'll find it from a pool of people who you wouldn't typically find it from. We'll go to YMCAs, church groups, local community centres and try to cast the show."

The winner of the series will receive a prize yet to be determined, although producers are entertaining the idea of relating it to Jackson's upcoming world tour - which kicks off on 10 September.

Jackson's show signals a turnaround from her turbulent relationship with the network. She was rumoured to be blacklisted by the station after her infamous wardrobe malfunction during a performance with Justin Timberlake at the 2004 Superbowl halftime show the network produced.

Jackson Scraps Plans For European Tour

Janet Jackson has reportedly scrapped any plans to hit Europe with her forthcoming Rock Witchu tour following her record label's decision to cease promoting her latest album, Discipline.

The Nasty singer was due to play a series of live dates across Europe after embarking on her first series of concert shows for seven years in the U.S. and Canada, with her first gig in Vancouver, Canada on 10 September.

However, the singer has now decided to just dedicate herself to the North American leg of her tour, citing frustration with her Def Jam label bosses' lack of support in promoting her new album, according to People.com.

The star tells hip-hop website Sohh.com, "It was definitely in my heart to go to Europe and to support this album... it's about teamwork, it's not something I can totally do on my own.

"Unfortunately, things have turned out the way that they have with the differences between the label and myself."

Earlier this month, Jackson told how there will be no further singles from her Discipline album, after record label bosses were disappointed with sales - shifting only 392,000 copies in the U.S.

She explained, "I'm trying to figure out a way to say this, but just to say it and to be quite honest, they just stopped all promotion whatsoever on the album, so I don't think you're going to hear another single off this album."

At the height of her popularity, Jackson scored 19 hit singles from just three LPs - Control, Rhythm Nation: 1812 and janet. And she still holds the record for scoring number ones in America from the same album, over three successive years.

Jackson Promotion Pulled

Janet Jackson has another album flop on her hands - bosses at her record label have ceased promoting Discipline and there are no more single releases planned.

Jackson, who once broke chart records with seven U.S. top five hits from one album - Rhythm Nation 1812, has scored only one hit from her new release, Feedback.

And there are no plans to try to top that.

In a disappointing email correspondence to celebrity blogger Perez Hilton, Jackson writes, "We started off with Feedback and the label and myself haven't quite seen eye to eye since the Feedback single so they've kind of basically stopped all promotion.

"I'm trying to figure out a way to say this, but just to say it and to be quite honest, they just stopped all promotion whatsoever on the album, so I don't think you're going to hear another single off this album."

Jackson Surprises The View Host Shepherd

Hit TV shows Brothers + Sisters and Ugly Betty repeated their success at the 2008 Gay and Lesbian Alliance Against Defamation Media Awards on Saturday by scooping the same top awards as last year.
